担保抹消のために清算人選任申立

根抵当権者はＡ社、債務者がＢ、不動産所有者はＣ
今般、Ｃが不動産を処分することになったのだが、それにはまず根抵当権を抹消する必要がある
しかし、Ａ社は５年前に解散し清算結了も済んでおり、消滅している
Ｃによれば、
『 Ｂが「Ａ社と俺は根抵当権を抹消する約束した」と言っていたような気がする 』
ということだが、Ｂは７年前に死亡しているので、真実は闇の中・・・
抹消登記に必要な書類も案の定、Ｃの手元にはない
そこで、Ａ社のかつての本店所在地を管轄する横浜地裁へＡ社の清算人申立をした
司法書士が根抵当権抹消登記を申請するときは、Ａ社の代表者（清算人）から委任を受ける必要があるのだが、登記簿上消滅しているＡ社には清算人が存在しない状態なのだ
横浜地裁によると
「うちは、こうした場合、地元の弁護士を清算人として選任する」
という
いずれ横浜の弁護士さんにお会いして、委任状などの書類に署名捺印していただくことになろう
（現段階では、清算人は選任されていない）
