新生フィナンシャル 一連を認める

最終取引日までの過払い金は約１０２万円（利息は約２０万円）
レイクから電話が入った
「途中、２度の分断があるので、最初の２つの取引の過払い金については消滅時効を主張します。そうしますと、過払い金は８５万円ほどになります」
たしかに２度の途中完済（１９９４年４月と１９９５年７月）があるのは事実
しかし、Ａさんが新生フィナンシャルから直接入手した「顧客契約リスト」によると、両者の間に締結された契約は
①１９９２年１１月１１日の基本契約
②１９９８年１２月１１日の切替契約
のふたつだけ
途中完済後の新たな借り入れの際に、新規契約を締結した事実はない
つまり、本件の入出金はすべて、１９９２年の基本契約（及び９８年の切替契約）に基づくものであり、「一連計算」が許容されるケースのはずだ
その旨をご担当者に伝えると、あっさり一連計算を認めてくれた
取引終了後に発生した利息も一部付加した１３０万円を９月に返還いただく内容で合意
調停期日を変更してもらい、新生フィナンシャルからの入金を確認次第、本件訴訟を取下げる
